Jakarta, hainews.id – Semua perusahaan pers media siber yang tergabung dalam Serikat Media Siber Indonesia (SMSI) menyatakan menolak rancangan Peraturan Presiden (Perpres) Media Berkelanjutan “Publisher Right” atau hak penerbit.
Demikian keputusan sidang Rapat Kerja Nasional (Rakernas) SMSI yang dibacakan oleh Ketua Umum SMSI Pusat, Firdaus pada Hari Ulang Tahun SMSI ke-6 di Hall Dewan Pers, Jakarta, Selasa (7/3/2023) malam.
Sidang pembahasan tentang publisher right dalam Rakernas SMSI diketuai oleh Sihono HT (SMSI Yogyakarta), Sekretaris Bustam (SMSI Papua Barat), anggota HM Syukur (SMSI Nusa Tenggara Barat), Aldin Nainggolan (SMSI Aceh), Fajar Arifin (SMSI Lampung).
Dalam keputusan sidang menetapkan, pertama peserta Rakernas SMSI dengan tegas menolak Perpres Publisher Right yang mempersempit hak perusahaan pers kecil untuk hidup.
Kedua, Perpres Publisher Right memperkuat hegemoni media main stream dan menutup media start up.
Ketiga, Perpres Publisher Right menciptakan persaingan bisnis yang tidak sehat, dan bertentangan dengan semangat undang-undang nomor 40 tahun 1999 tentang pers.
Keempat, SMSI sebagai konstituen Dewan Pers mendesak Dewan Pers untuk tidak mengusulkan draft Perpres kepada presiden untuk mengatur tentang pers.
Kelima, meminta Dewan Pers menjaga keberlangsungan hidup perusahaan pers kecil di Indonesia.
Keenam, memohon Presiden Joko Widodo untuk tidak menandatangani draft Perpres Publisher Right yang diserahkan oleh Kementerian Komunikasi dan Informatika atau dari siapapun.
Ketujuh, mengimbau kepada seluruh perangkat pemerintah RI untuk tidak ikut campur dalam menelurkan regulasi terkait perusahaan pers selain yang termaktub dalam undang-undang nomor 40 tahun 1999 tentang pers.
Kedelapan, anggota SMSI dengan tegas berkomitmen menegakkan kode etik jurnalistik dan undang-undang tentang pers, serta pedoman pemberitaan media siber.
Dengan tegas SMSI menyatakan menolak rancangan Perpres Media Berkelanjutan Publisher Right. Keputusan ini merupakan hasil Rakernas SMSI yang dihadiri seluruh perwakilan 34 provinsi di Indonesia.
Bertentangan dengan Semangat Presiden RI
Hal yang memicu kegelisahan anggota SMSI seluruh Indonesia, sehingga merasa terganggu, dengan munculnya pasal 8 bab V ayat 1 dan 2, dalam rancangan perpres tersebut.
Rancangan Perpres itupun bertentangan dengan semangat Presiden RI Joko Widodo yang ingin menghidupkan Usaha Mikro Kecil Menengah/ Usaha Kecil dan Menengah (UMKM/UKM) melalui usaha media sturt up yang diinisiasi oleh anak-anak muda di seluruh wilayah Tanah Air.
Berkali-kali Presiden menyampaikan komitmen tersebut, bahkan dalam event G-20 di Bali November 2022 lalu, komitmen ini ditegaskan kembali oleh Presiden Joko Widodo untuk mendorong tumbuh berkembangnya UMKM dan usaha rintisan atau start up di Tanah Air.
Sementara pasal 8 tersebut justru akan membunuh semangat itu. Dalam pandangan SMSI, Pasal 8 Draft Perpers jelas-jelas tidak memberi ruang untuk sebagian terbesar media-media online di daerah, media-media kecil yang notabene UMKM.
Pada Pasal 8 bab V tentang Perusahaan Pers dalam rancangan Perpres yang diajukan kepada Presiden Joko Widodo tersebut berbunyi:
(1) Perusahaan Pers yang berhak mengajukan permohonan
kepada Dewan Pers atas pelaksanaan Tanggung Jawab
Perusahaan Platform Digital adalah Perusahaan Pers yang telah terverifikasi oleh Dewan Pers.
(2) Perusahaan Pers yang belum terverifikasi oleh Dewan
Pers dapat mengajukan permohonan verifikasi kepada Dewan Pers.
Adapun verifikasi media oleh Dewan Pers dikhawatirkan mengganggu kemerdekaan pers di Tanah Air yang dijamin oleh Undang-Undang Nomor 40 Tahun 1999 Tentang Pers yang seharusnya menjadi pedoman bersama.
Hadir dalam acara HUT SMSI tersebut antara lain Ketua Komisi II DPR-RI, Ahmad Doli Kurnia Tandjung, Ketua PWI Pusat Atal S Depari, Dewan Pembina SMSI Mayjen TNI (Purn.) Joko Warsito, Sri Datuk Panglima Tjut Erwin Suparjo, Penasehat SMSI Ervik Ari Susanto, Ketua Umum Perkumpulan Pemimpin Redaksi Media Siber Indonesia Iman Handiman, Ketua Badan Siber Nasional SMSI Laksdya TNI Purn. Agus Setiadji, Wakil Ketua Dewan Pers Periode 2019-2022 Hendry Ch Bangun, serta Dewan Pertimbangan SMSI KH. M. Ma’shum Hidayatullah, Theodorus Dar Edi Yoga, dan GS Ashok Kumar. (*)
